These Terms and Conditions set out the basis on which Gardeners Aldwych provides gardening and related services to domestic and commercial customers in the United Kingdom. By booking or receiving any service from Gardeners Aldwych, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you should not place a booking or continue with a service.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below.

Customer means the individual or business that books or receives services from Gardeners Aldwych.

Company, we, us or our means Gardeners Aldwych, the gardening services provider.

Services means any gardening, garden maintenance, landscaping, clearance, planting, lawn care, hedge cutting, pruning, pressure washing, or related services provided by the Company.

Service Address means the property or site where the Services are to be carried out.

Booking means a confirmed request for Services made by the Customer and accepted by the Company.

2. Scope of Services

2.1 Gardeners Aldwych provides a range of gardening and outdoor maintenance services, which may include routine garden care, seasonal work, planting, soft landscaping, minor hard landscaping, garden clearance, and related services as agreed with the Customer.

2.2 The specific scope of work for each Booking will be confirmed either as a fixed-price job or on an hourly rate basis, depending on the nature of the requested Services.

2.3 Any description of Services provided on promotional materials or general information pages is illustrative only. The exact Services provided for each Customer will be as described in the Booking confirmation or quotation issued by the Company.

3. Booking Process

3.1 Bookings may be requested by the Customer through the Companys accepted communication channels as indicated on its website or promotional materials. The Customer must provide accurate information regarding the Service Address, property access, garden size, and required Services.

3.2 A Booking is only confirmed when the Company has accepted the request, provided a quotation or rate, and issued a confirmation of the appointment date and time frame.

3.3 For some Services, an initial on-site visit or survey may be required before a quotation can be issued. Such visits may be chargeable, and the Customer will be informed in advance where a fee applies.

3.4 The Customer is responsible for ensuring that the person making the Booking has the authority to do so and to enter into a binding contract on behalf of any other property owners or occupiers.

4. Quotations and Estimates

4.1 Any quotation provided by the Company is valid for a limited period as stated on the quotation itself or, where no period is stated, for 30 days from the date of issue.

4.2 Quotations are based on the information provided by the Customer and any site inspection carried out by the Company. If, on arrival, the Company finds that the information on which the quotation was based is incomplete or inaccurate, or that the condition of the garden or access arrangements are materially different, the Company reserves the right to revise the quotation or charge on a time and materials basis.

4.3 Where the Company provides an estimate rather than a fixed quotation, the final price may vary to reflect the actual time taken, materials used, and any additional work agreed with the Customer.

5. Prices and Payments

5.1 Prices for Services will be provided to the Customer before work commences, either as an hourly rate, a fixed fee, or a combination of both.

5.2 All prices are quoted in pounds sterling and may be subject to applicable taxes, which will be stated where relevant.

5.3 The Company may require a deposit or advance payment for certain Services, particularly larger projects, clearance work, or where materials need to be purchased in advance. The amount of any deposit will be confirmed at the time of Booking.

5.4 Unless otherwise agreed in writing, payment for Services is due immediately on completion of the work for one-off jobs, or on the agreed billing date for regular maintenance contracts.

5.5 The Company accepts payment by methods specified by the Company from time to time. The Customer agrees to pay in full and on time, and to ensure that any bank or card details used are valid and authorised.

5.6 If payment is not received by the due date, the Company reserves the right to charge interest on overdue sums at the statutory rate permitted under UK law, and to recover any reasonable costs incurred in pursuing late payment, including debt recovery or legal costs.

6. Cancellations and Rescheduling

6.1 The Customer may cancel or reschedule a Booking, provided that the Company receives at least 24 hours notice before the scheduled appointment time, or such other notice period as may be specified for particular Services.

6.2 If the Customer cancels or reschedules with less than the required notice, the Company reserves the right to charge a late cancellation fee, which may be up to the full value of the scheduled Service, depending on the circumstances and any incurred costs.

6.3 If the Company needs to cancel or reschedule a Booking due to weather conditions, staff availability, safety concerns, or other unforeseen circumstances, the Company will notify the Customer as soon as reasonably practicable and offer an alternative appointment. The Company will not be liable for any loss arising from such cancellation or rescheduling, other than refunding any pre-paid sums for Services not delivered.

6.4 Where access to the Service Address is not available at the agreed time, or the Customer fails to be present if their presence is required, and this prevents the Company from carrying out the work, this may be treated as a late cancellation and charged accordingly.

7. Access and Customer Responsibilities

7.1 The Customer must provide safe and reasonable access to the garden or outdoor areas where the Services are to be carried out, including access through any gates, communal areas, or buildings as needed.

7.2 The Customer is responsible for ensuring that pets, children, and other occupants are kept away from areas where work is being carried out and from any tools or equipment being used.

7.3 The Customer must inform the Company of any known hazards at the Service Address, such as unstable structures, concealed ponds, uneven ground, or underground services, as well as any relevant restrictions, covenants, or permissions that may affect the work.

7.4 If the Company considers that working conditions are unsafe or inappropriate, it may suspend or refuse to carry out the Services until the situation is rectified. In such cases, the Customer may be liable for any wasted time or costs incurred.

8. Materials, Plants and Quality of Work

8.1 Where the Company supplies materials, plants, turf, or other items, it will use reasonable care to select products of suitable quality and specification for the agreed Services.

8.2 The Company cannot guarantee the lifespan or performance of plants, turf, or living materials after installation, as these depend on factors outside its control, including weather, soil conditions, pests, diseases, and the Customers ongoing care and maintenance.

8.3 The Customer is responsible for following any aftercare instructions provided by the Company, including watering, feeding, mowing, pruning, and protection from extreme weather or pests.

8.4 Any concerns about the standard of workmanship must be notified to the Company as soon as reasonably possible, and in any event within a reasonable period after completion, so that the Company has an opportunity to inspect and, where appropriate, rectify the issue.

9. Waste Removal and Environmental Regulations

9.1 Gardeners Aldwych will comply with applicable UK waste and environmental regulations when handling and disposing of garden waste arising from its Services.

9.2 Unless expressly included in the quotation or Booking, the collection and removal of garden waste, soil, rubble, or other materials is not automatically included in the Service. The Customer should confirm at the time of Booking whether waste removal is required and whether additional charges apply.

9.3 Where the Company agrees to remove garden waste, it will arrange for transport and lawful disposal or recycling in accordance with current regulations. The Company reserves the right to refuse to remove certain types of waste, including hazardous materials, contaminated soil, or waste that falls outside the scope of standard garden refuse.

9.4 If the Customer chooses to retain garden waste on site, the Customer must ensure that storage or composting complies with any applicable local regulations and does not create a nuisance or hazard.

10. Liability and Insurance

10.1 The Company will exercise reasonable skill and care in the provision of the Services and will take reasonable steps to avoid damage to the Customers property and possessions.

10.2 The Company holds appropriate public liability insurance for the nature of its gardening activities. Details of cover may be made available to the Customer on request.

10.3 The Company will not be liable for any loss or damage that arises from inaccurate information provided by the Customer, failure to follow the Companys instructions, or any act or omission of the Customer or third parties.

10.4 The Company will not be responsible for pre-existing faults, defects, or weaknesses in the Customers property, including fences, walls, patios, sheds, greenhouses, or vegetation, which may become apparent during the performance of the Services.

10.5 To the fullest extent permitted by law, the Company excludes liability for any indirect or consequential loss, including loss of enjoyment, loss of use, or loss of profit. Nothing in these Terms and Conditions limits or excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under UK law.

11. Complaints

11.1 If the Customer is dissatisfied with any aspect of the Services, they should contact the Company as soon as possible, giving clear details of the concern and the relevant Booking.

11.2 The Company will investigate complaints in a fair and timely manner and, where appropriate, may propose remedial work, a partial refund, or another form of resolution, depending on the circumstances.

12. Force Majeure

12.1 The Company shall not be liable for any delay or failure in performing its obligations where such delay or failure results from events or circumstances beyond its reasonable control. This may include severe weather, storms, floods, droughts, pandemics, strikes, transport disruptions, or other unforeseeable events.

12.2 In such circumstances, the Company may suspend or cancel affected Bookings and will seek to reschedule the Services when reasonably possible.

13. Data Protection and Privacy

13.1 The Company will collect and use personal data from Customers for the purposes of managing Bookings, providing Services, processing payments, and administering its business.

13.2 The Company will handle personal data in accordance with applicable UK data protection laws and will take reasonable steps to keep such data secure.

14. Amendments to These Terms

14.1 The Company may update or amend these Terms and Conditions from time to time. The version in force at the time of the Customers Booking will apply to that Booking.

14.2 Any significant changes to these terms may be notified on the Companys website or through other appropriate means.

15. Governing Law and Jurisdiction

15.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.

15.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.

By proceeding with a Booking or receiving Services from Gardeners Aldwych, the Customer confirms that they have read, understood, and agree to be bound by these Terms and Conditions.
